Terms and Conditions

Welcome to Breastfriend NZ Ltd ("we," "our," or "us"). By accessing our website or purchasing our products, you agree to comply with these Terms and Conditions. Please read them carefully.

1. Compliance with New Zealand Consumer Laws

We are committed to adhering to all applicable New Zealand consumer protection laws, including the Fair Trading Act 1986 and the Consumer Guarantees Act 1993.

  • Fair Trading Act 1986: This Act prohibits misleading or deceptive conduct, false representations, and unfair practices. We strive to ensure all information provided is accurate and not misleading.
  • Consumer Guarantees Act 1993: This Act provides guarantees for goods and services bought for personal use, ensuring they are of acceptable quality, fit for purpose, and match descriptions.

2. Orders and Payments

  • Pricing: All prices are listed in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) unless stated otherwise.
  • Payment Methods: We accept payments via debit or credit card or ZIP. Full payment is required before order dispatch.
  • Order Confirmation: Once an order is placed, you will receive a confirmation email detailing your purchase.

3. Shipping and Delivery

  • Processing Time: We aim to process and dispatch orders within one business day of receiving payment.
  • Shipping: Orders are sent via tracked express shipping within New Zealand and Australia, with estimated delivery times of 1–5 business days.
  • Pre-Orders: If a product is on pre-order, the expected availability date will be displayed on the product page. While we strive to meet these dates, unforeseen delays may occur. We will notify you via email of any changes.
  • Delivery: Once an order is handed to the courier, delivery times are beyond our control.

4. Returns and Refunds

    Change of Mind Returns We can only accept change-of-mind returns on The Breasties pump set, and only if the pumps remain sealed in their original or alternate protective packaging with the hygiene seal fully intact and unopened, and the return is requested within 7 days of delivery. If any seal has been broken, the case or packaging opened, or parts removed, the pump set is no longer eligible for return. All other items — including silver nipple cups, milk storage bags, pump parts, and accessories — are non-returnable for change of mind due to hygiene and safety reasons.

    Faulty or Defective Products If you believe your product is faulty, damaged, or not performing as expected, please contact us at hello@breastfriend.co.nz. You may be entitled to a repair, replacement, or refund under the Consumer Guarantees Act and our Limited Warranty.

    Warranty coverage:

    • 12 months — pump motor, battery, and charging components
    • 90 days — pump parts such as flanges, valves, diaphragms, and connectors

    The warranty covers manufacturing defects only and excludes damage caused by: milk or liquid inside the motor, display, or charging port; use of non-approved chargers; failure to remove the motor before pouring milk; submerging the motor or exposing it to steam, refrigeration, or freezing; dropping, over-tightening, or forcing components; normal wear and tear; or repairs and modifications not authorised by Breastfriend NZ Ltd.

    Approved chargers: Only use chargers or USB ports that output 5V (e.g. "Output: 5V ⎓ 1A", "5V ⎓ 2A", or "5V ⎓ 3A"). Suitable options include standard non-fast-charge phone chargers and USB ports on laptops or PCs. Do not use fast-charging adapters, high-voltage wall plugs, or multi-port chargers exceeding 5V — these can permanently damage the motor and will void your warranty. Breastfriend NZ Ltd accepts no responsibility for damage caused by use of incorrect chargers. Any evidence of liquid ingress, electrical damage, or use of incompatible chargers voids the warranty.

    Assessment Process Before a replacement or refund can be issued, the product must be assessed. We may complete a visual inspection from clear photos or video. If the issue cannot be verified visually, the full pump set (both motors and accessories) must be returned for inspection via tracked courier with signature required, including your invoice or order number.

    If a manufacturing fault is confirmed, we will repair or replace the affected component at no cost and reimburse your reasonable return shipping costs (with proof of cost). If no fault is found and the product performs within specification, it will be returned to you and no refund or replacement will be issued. Assessment outcomes are final.

    Condition of Returned Items Returned items must be unused, in original packaging, and in resalable condition (unless returned for fault assessment). Items returned incomplete, damaged, or showing use inconsistent with the reported fault will be returned without refund or replacement.

    Refunds Approved refunds are processed back to your original payment method within 7 business days. Shipping costs are refunded only if the item was incorrectly sent or proven faulty after inspection. We do not charge a restocking fee for returned items

5. Privacy and Data Protection

We are committed to protecting your privacy in accordance with the Privacy Act 2020. Our Privacy Policy details how we collect, use, and protect your personal information.

6. Limitation of Liability

  • Accuracy: While we strive to provide accurate product information, we do not guarantee that descriptions, images, or pricing are error-free.
  • Liability: To the extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from the use of our products or website.

7. Intellectual Property

All content on this website, including text, images, logos, and graphics, is our property or used with permission. You may not copy, modify, or distribute any content without our written consent.

8. Governing Law

These Terms and Conditions are governed by the laws of New Zealand. Any disputes will be subject to the jurisdiction of New Zealand courts.
